Rules of the prize competition called
“CACTUS COLLEGE – CLASS OF 2026”
CACTUS FOR YOU Srl, with registered office in Via Fausto Melotti, 2 – 20138 Milan, is announcing a prize competition called “CACTUS COLLEGE — CLASS OF 2026”, which will take place according to the procedures described below.
Art. 1) DELEGATED SUBJECT
The promoter delegates the company MAX MARKETING Srl, with operational headquarters at Via Cassala n. 16/18 Brescia and registered office at Via F. Pontara n. 26 Concesio (BS), to carry out the administrative procedures relating to this prize competition.
Art. 2) DURATION
Advertising start date: December 14, 2025.
Participation period: from 9:00 am on December 16, 2025 to 11:59:59 pm on December 17, 2025.
Art. 3) TERRITORIAL SCOPE
Entire national territory and the Republic of San Marino.
Art. 4) RECIPIENTS OF THE PRIZE COMPETITION
The prize competition is open to adult end consumers, resident or domiciled in Italy or the Republic of San Marino (hereinafter for brevity the “Customers”).
Art. 5) PRIZE MONEY
6 full scholarships to access the CACTUS COLLEGE program – Class of 2026. The package includes:
• 5-day intensive training course, from 2 to 6 March 2026 at the CACTUS FOR YOU headquarters;
• overnight stay in a 4-star hotel from 1 to 7 March 2026;
• meals throughout the course.
Transportation costs to the course location are not included.
Prizes are not transferable to third parties.
In the event of extraordinary events or force majeure, the promoting company reserves the right to modify the training dates and times, while guaranteeing that the planned activities will continue.
Approximate prize pool value: €24,408.00 including VAT.
Art. 6) PROCEDURE
To participate in this prize competition, Customers must make purchases on the website www.cactusforyou.it during the validity period indicated in these rules.
For every order placed, regardless of the amount, the customer will receive a three-box scratch-off coupon inside the package. By scratching off the three boxes, symbols will appear: customers who find three matching symbols win one of the prizes up for grabs.
You can participate multiple times by placing multiple orders during the validity period. However, each customer can only win one prize.
Each Scratch & Win coupon included in the packages is personal and non-transferable.
The right to participate is reserved exclusively for the person who placed the order and who generated the coupon.
The transfer of the coupon to third parties is not permitted, either free of charge or for a fee.
The prize can be validated, in the manner specified below, only if the name of the participant matches that of the order placed.
Art. 7) VALIDATION OF THE WIN
To validate the win, the Customer must send, by January 15, 2026, via registered mail with return receipt or courier:
• the original winning coupon, intact and legible (not altered, damaged or counterfeited),
• a copy of a valid identity document;
• your complete personal details (name, surname, address, telephone number, email address).
To properly validate your win, the name on the document you submit must match the name on the order placed on the site.
In case of discrepancies, participation cannot be validated.
Coupons associated with canceled, returned, refunded, or unclaimed orders will automatically be considered void and will not entitle you to any participation or prize. The Promoter reserves the right to verify the validity of orders using the purchase number.

In the event of non-receipt within the established deadlines, or in the presence of incomplete, altered or non-compliant documentation, the Customer will automatically forfeit the right to the prize, which will therefore be awarded to the non-profit organization indicated below.
In the event of suspected irregularities, the promoting company reserves the right to carry out checks, request additional documentation, or cancel participation.
Art. 8) BENEFICIARY NON-PROFIT ORGANIZATION
In the event that it is not possible to award one or more prizes, they will be donated to:

Any prizes refused will remain at the disposal of the promoting company.
Art. 9) PRIZE AWARDING
Winners will receive a voucher representing their prize within 30 days of the award date.
Winners are required to personally participate in the training program required by the prize. Refusal of the prize does not entitle the winner to nominate a replacement.
Art. 10) DUTIES AND GUARANTEES
It should be noted that
• the website www.cactusforyou.it is powered by Shopify, a global cloud service with data centers distributed across various regions, managed by enterprise-grade infrastructure. For European merchants, Shopify automatically stores store, order, and customer data in Europe (EEA, UK, and/or Switzerland) by default in compliance with GDPR regulations. The promoter sets up a replication service for participant data on servers located in Italy;
• the winning and non-winning coupons will be mixed and distributed randomly; the promoting company will provide a specific declaration in lieu of a sworn statement attesting to the mixing and random distribution of the winning and non-winning coupons;
• The promoter declines all responsibility for any access problems, impediments, malfunctions, or difficulties involving technical equipment, computers, telephone lines, cables, electronics, software, and hardware, transmission and connection, internet connection, accessibility to the online competition, and landline and mobile telephone networks that may prevent a user from participating in the competition. It also declines all responsibility for problems caused by the configuration of the user's computer/device that may affect the user's performance during participation;
• the promoting company reserves the right to proceed, within the terms deemed most appropriate, and in compliance with the laws in force, to limit and inhibit any initiative aimed at circumventing, in a manner deemed incorrect, the "system" of this prize competition.
Art. 11) WAIVER OF RECOURSE
The promoting company declares that it waives the right to recover withholding tax in favor of the winners pursuant to art. 30 of Presidential Decree no. 600 of 29 September 1973.

Art. 13) PROCESSING OF PARTICIPANTS' PERSONAL DATA
During the prize competition, CACTUS FOR YOU Srl, with registered office at Via Fausto Melotti, 2 – 20138 Milan, processes the personal data provided by participants exclusively to properly manage the competition, from collecting the postcards to the drawing, up to notifying the winners and awarding the prizes. To ensure efficient and compliant organization, the Data Controller uses carefully selected suppliers; among these, MAX MARKETING Srl acts as Data Processor pursuant to Art. 28 GDPR, limited to the technical tasks related to the competition management and in accordance with the instructions received.
The data required is strictly necessary for the identification and contact of the participant (e.g., name, surname, email, telephone number). Only in the event of a win may identity verification be requested via a copy of a document, to ensure the correct award of the prize. The site is hosted on the Shopify platform, provided by Shopify International Ltd. (Ireland) and Shopify Inc. (Canada), which act as data processors for hosting, e-commerce, and related technical functions (e.g., security, abuse prevention, maintenance). Shopify uses selected subcontractors; the relevant data processing agreement (DPA) and the list of subprocessors are provided by Shopify. Use of Shopify may involve data transfers to countries outside the EEA (particularly Canada and, where necessary for certain services, the United States). Such transfers are carried out in compliance with Articles 44 et seq. of the GDPR, through the European Commission's standard contractual clauses and, where applicable, additional security measures. The additional guarantees that Shopify declares to apply in relation to its suppliers remain unchanged. To ensure the correct management of the contest and full verifiability by the authorities and the competent notary/official, the Owner has adopted a contest data mirroring system, compliant with Italian legislation on prize contests (Presidential Decree 430/2001 and implementing practices).
Legal bases and purposes
Processing occurs for the following purposes and legal bases:
Competition management (collection of postcards, registration, drawings, contacting winners, prize delivery): Art. 6.1.b GDPR (execution of pre-contractual/contractual measures related to participation) and Art. 6.1.c GDPR (legal obligations regarding prize competitions).
Administrative, accounting, and tax obligations related to the awarding of prizes: art. 6.1.c GDPR.
Complaint management, abuse prevention, and legal defense: Art. 6.1.f GDPR (legitimate interest of the Data Controller).
Promotional communications from the Data Controller (only if you provide separate consent): Art. 6.1.a GDPR (consent can be freely withdrawn at any time).
Rights of interested parties
You may always exercise the rights recognized under Articles 15–22 of the GDPR (access, rectification, erasure, restriction, portability, objection) and withdraw any consent given, without affecting the lawfulness of any processing already carried out. Art. 14) ACCEPTANCE OF THE REGULATIONS
Participation in this prize competition implies full and unconditional acceptance by participants of all the clauses of these rules.
