Regulations of the prize competition called
“CACTUS COLLEGE – CLASS OF 2026”
CACTUS FOR YOU S.r.l. with registered office at Via Fausto Melotti, 2 – 20138 Milan announces the prize competition called “CACTUS COLLEGE — CLASS OF 2026”, which will take place according to the methods described below.
Art. 1) DELEGATED ENTITY
The promoting entity delegates the company MAX MARKETING S.r.l. with operational headquarters at Via Cassala n. 16/18 Brescia and registered office at via F. Pontara n. 26 Concesio (BS), to carry out the administrative procedures related to this prize competition.
Art. 2) DURATION
Start date of advertising: December 14, 2025.
Participation period: from 9:00 AM on December 16, 2025, to 11:59:59 PM on December 17, 2025.
Art. 3) TERRITORIAL SCOPE
Entire national territory and the Republic of San Marino.
Art.4) RECIPIENTS OF THE PRIZE COMPETITION
The prize competition is aimed at adult final consumers, residing or domiciled in Italy or in the Republic of San Marino (hereinafter briefly referred to as "Customers").
Art. 5) PRIZE POOL
Nr. 6 “training bags” complete to access the CACTUS COLLEGE program – Class of 2026. The package includes:
• intensive training course of 5 days, from March 2 to March 6, 2026 at the CACTUS FOR YOU headquarters;
• accommodation in a 4-star hotel from March 1 to March 7, 2026;
• meals throughout the duration of the course.
Transportation costs to reach the course location are excluded.
Prizes are not transferable to third parties.
In case of extraordinary events or force majeure, the promoting company reserves the right to change dates and times of the training, while ensuring the maintenance of the planned activities.
Indicative value of the prize pool euro 24,408.00 VAT included.
Art. 6) MODALITIES OF CONDUCT
To participate in this prize competition, Customers must make purchases on the website www.cactusforyou.it during the validity period indicated in these regulations.
For each order placed, of any amount, the Customer will receive a "scratch" ticket inside the package with 3 boxes. By scratching the 3 boxes, symbols will appear: customers who find 3 identical symbols win one of the prizes available.
It is possible to participate multiple times by placing more orders during the validity period. However, each Customer can win only one prize.
Each scratch ticket included in the packages is personal and non-transferable.
The right to participate is reserved exclusively for the holder of the order that generated the ticket.
The transfer of the ticket to third parties is not permitted, either free of charge or for a fee.
The prize can only be validated, in the manner specified below, if the name of the participant matches that of the order placed.
Art. 7) VALIDATION OF THE PRIZE
To validate the prize, the Customer must send by registered mail A/R or by courier, by January 15, 2026:
• the original of the winning ticket, intact and legible (not altered, damaged, or counterfeit),
• a copy of a valid identity document;
• their complete personal data (name, surname, address, phone, email).
For the correct validation of the prize, the name on the document sent must correspond to the name of the person who placed the order on the site.
In case of discrepancies, the participation cannot be validated.
The coupons associated with canceled, returned, refunded, or uncollected orders will be automatically considered null and will not entitle the holder to any participation or prize. The Promoting Company reserves the right to verify the validity of the orders through the purchase number.

In case of non-receipt within the established deadlines, or in the presence of incomplete, altered, or non-compliant documentation, the Customer will automatically lose the right to the prize, which will therefore be awarded to the following charity.
In case of suspected irregularities, the promoting company reserves the right to carry out checks, request additional documentation, or cancel the participation.
Art.8) BENEFICIARY ONLUS
In case of inability to assign one or more prizes, they will be donated to:

Any prizes that are refused will remain available to the promoting company.
Art. 9) DELIVERY OF PRIZES
The winners will receive a voucher representing the prize within 30 days from the date of assignment.
The winners are required to personally participate in the training course provided by the prize. Any refusal of the prize does not entitle the designation of a substitute.
Art. 10) COMPLIANCE AND GUARANTEES
It is specified that
• the site www.cactusforyou.it is based on Shopify, a global cloud service with data centers distributed in various regions, managed by enterprise-level infrastructure.For European merchants, Shopify automatically stores store, order, and customer data in Europe (EEA, UK, and/or Switzerland) by default in compliance with GDPR regulations. The promoting company sets up a data replication service for participants on a server located in Italian territory;
• the winning and non-winning tickets will be mixed and distributed randomly; the promoting company will provide a specific substitute declaration certifying the mixing and random distribution of the winning and non-winning tickets;
• the promoting company disclaims any responsibility for any access problems, impediments, dysfunctions, or difficulties regarding technical tools, computers, telephone lines, cables, electronics, software and hardware, transmission and connection, internet connection, accessibility to the online competition, and the mobile and fixed telephone network that may prevent a user from participating in the competition.The company also declines any responsibility for problems caused by the configuration of the user's computer/device that may affect the user's performance during participation;
• the promoting company reserves the right to proceed, in the terms deemed most appropriate, and in compliance with current laws, to limit and inhibit any initiative aimed at circumventing, in a manner considered incorrect, the "system" of this prize competition.
Art. 11) WAIVER OF RECOVERY
The promoting company declares that it waives the right to recover the withholding tax in favor of the winners pursuant to art. 30 D.P.R. September 29, 1973, no. 600.

Art.13) TREATMENT OF PERSONAL DATA OF PARTICIPANTS
During the prize initiative, CACTUS FOR YOU S.r.l, with registered office at Via Fausto Melotti, 2 – 20138 Milan, processes the personal data provided by participants exclusively to properly manage the competition, from the collection of postcards to the draw, up to communications to the winners and the delivery of prizes. To ensure efficient organization and compliance with regulations, the Data Controller uses carefully selected suppliers; among these, MAX MARKETING S.r.l acts as Data Processor pursuant to art. 28 GDPR, limited to the technical tasks related to the management of the competition and in accordance with the instructions received.
The requested data is strictly necessary for the identification and contact of the participant (e.g.name, surname, email, phone); only in case of winning will a verification of identity be requested through a copy of a document, in order to ensure the correct attribution of the prize. The site is hosted on the Shopify platform, provided by Shopify International Ltd. (Ireland) and Shopify Inc. (Canada), which act as data processors for hosting services, e-commerce, and related technical functionalities (e.g., security, abuse prevention, maintenance). Shopify uses selected sub-processors; the relevant data processing agreement (DPA) and the list of sub-processors are made available by Shopify. The use of Shopify may involve data transfers to non-EEA countries (in particular Canada and, where necessary for certain services, the United States). Such transfers occur in compliance with Articles 44 et seq. GDPR, through standard contractual clauses of the European Commission and, where applicable, additional security measures.The additional guarantees that Shopify declares to apply in relation to its suppliers remain unchanged. To ensure the correct management of the competition and full verifiability by the authorities and the competent notary/official, the Owner adopts a data mirroring system for the competition, in compliance with Italian regulations on prize competitions (D.P.R. 430/2001 and applicable practices).
Legal bases and purposes
The processing takes place for the following purposes and legal bases:
Management of the competition (collection of postcards, registration, draws, contact with winners, delivery of prizes): art. 6.1.b GDPR (execution of pre-contractual/contractual measures related to participation) and art. 6.1.c GDPR (legal obligations regarding prize competitions).
Administrative, accounting, and tax obligations related to the awarding of prizes: art. 6.1.c GDPR.
Management of complaints, prevention of abuse, and defense in court: art. 6.1.f GDPR (legitimate interest of the Data Controller).
Promotional communications from the Data Controller (only if you provide separate consent): art. 6.1.a GDPR (consent freely revocable at any time).
Rights of the data subjects
The possibility to exercise the rights recognized by articles 15–22 GDPR (access, rectification, deletion, limitation, portability, opposition) remains unchanged, as well as to revoke any consent given, without affecting the lawfulness of the processing already carried out. Art. 14)ACCEPTANCE OF THE REGULATIONS
Participation in this prize competition implies full and unconditional acceptance by the participants of all the clauses of these regulations.
